LitWits Workshops, LLC (“LitWits,” “we,” “our,” or “us”) is committed to protecting your privacy. This Privacy Policy, along with our Terms of Use, applies to LitWits’ website, www.litwits.com, and any of its related or affiliated websites, mobile sites and related applications (collectively, the “Site”), including embeddable content that we may make available for use on other websites or digital platforms, other than third party content, as discussed in Third Party Links, Websites and Services, below.

If you do not agree with this Privacy Policy, please do not use the Site.

Information We Collect

We may obtain “Personal Information” through the Site that can be used to specifically identify an individual. The types of Personal Information we may obtain include:

  • Identity information. This may include information such as name or other similar identifiers.
  • Contact information. This may include information such as phone number, email and postal address for you or for others (e.g., principals in your business).
  • Financial information. This may include information such as payment or banking information, including name, billing address and payment card details. However, credit card information is never stored on our Site.

We may also collect data that in combination with Personal Information identifies or relates to a particular individual, such as:

  • Information used to create your online account. This may include information such as such as username, password and security question and answer.
  • Location data. This may include information such as data derived from your IP address, country and zip code, and the geolocation of your mobile device where we have provided notice and choice, as appropriate.
  • Internet or other electronic network activity information. This may include information such as clickstream data and other information about your online activities (such as information about your devices, browsing actions and usage patterns), including across the Site and third-party websites, that we obtain through the use of cookies, web beacons and similar technologies.
  • Other information contained in content you submit to us. This may include information obtained through our “Contact Us” link on our Site.

Information You Provide to Us Voluntarily

You may be asked to provide some Personal Information to participate in some activities on the Site. If you do not want this information to be collected or used by us, you can choose not to submit your information. However, this may prevent your participation in these activities. This may include, but are not limited to:

  • Registering for an account;
  • Participating in workshops and guides;
  • Receiving information about classes, products, or your Explorer’s Guides store account;
  • Receiving tips and updates, marketing emails, and new product information;
  • Participating in special offers from LitWits or its partners or affiliates;
  • Subscribing to our newsletter or publications;
  • Entering a competition, promotion or survey;
  • Making a purchase;
  • Commenting on content;
  • Contacting customer service; or
  • Giving us feedback.

Information We Collect Automatically

When you use the LitWits Site, we may also collect and store certain non-personally identifiable information automatically through the website’s standard server logs. This information helps us personalize and maximize the online experience you and other visitors have with the Site. This allows us to measure analytics (e.g., market penetration and demographics), manage, and improve the services available on the Site.

LitWits works with third parties to help us understand how people use our website, to track affiliate links for our affiliate partners, and to provide functionalities such as e-mail distribution, ad serving and user surveys. These companies may also use cookies or other tracking technologies, such as web beacons, which are similar in function to cookies, allowing them to determine when users have reached particular web pages on the LitWits website.

  • Cookies and web beacons. In order to provide optimal services and convenience we may use common Site tracking technologies, including cookies, pixels, tags, web beacons and other technologies to receive and store certain information. Cookies are small data files that our Sites send to your browser that are then saved on your computer or device. You can control the use of cookies through settings at the individual browser level, but if you disable cookies, it may limit your use of our Sites.   • Do Not Track (DNT) signals. Some web browsers may transmit Do Not Track (DNT) signals to the websites with which the user communicates.  Because of differences in how web browsers incorporate and activate this feature, it is not always clear whether users intend for these signals to be transmitted, or whether they even are aware of them.  We currently do not change our tracking practices in response to DNT settings in your web browser, and we do not obligate our third-party partners to change their tracking practices in response to DNT settings in your web browser.
  • Third party tracking. We use certain technologies to help us remember you and enhance your use of our Site, to manage and analyze service usage, and to promote content, products and services based on that usage. We may do this through third-party advertising or analytics companies (e.g., Google Analytics, Google AdWords, Facebook Pixel, and Amazon). LitWits does not control third party tracking.

This Site may contain links to other sites. LitWits is not responsible for the privacy practices or the content of Sites linked from the LitWits’ Site, nor does linking to other websites indicate any endorsements of the site or the products or information provided on such sites. By clicking on a third party link, you will leave the LitWits Site. Privacy and security policies may differ from those practiced by LitWits.

Amazon Associates Program

LitWits is a participant in the Amazon Services LLC Associates Program, an affiliate advertising program designed to provide a means for sites to earn advertising fees by advertising and linking to Amazon.com. Clicking on “this book” in our store pages will take you to Amazon.com, where you may choose to purchase books we have linked to. LitWits receives a small commission for your purchase.

How we use your information

LitWits does not sell, share or exchange your personal information without prior consent, except necessary to provide you with our services, as provided in this Privacy Policy, or as compelled by law.  We never use or share the personally identifiable information provided to us online in ways unrelated to the ones described above without also providing you an opportunity to opt-out or otherwise prohibit such unrelated uses.

In connection with an assignment, sale, joint venture, or other transfer of all or substantially all of our assets, LitWits reserves the right to assign, sell, license, or otherwise transfer to a third party your personally identifiable information.

Information we share with third parties

In some circumstances, we may share information we collect from you with authorized third-party service providers to help us fulfill requests and perform various functions necessary to provide and improve the Site, e-mailing, and administering the Explorer’s Guide program.

OPT OUT, Your Choices

LitWits offers you certain choices in connection with the Personal Information we obtain about you. To update your preferences or to submit a request, please contact us as specified in the “Contact Us” section of this Privacy Policy. To opt out of receiving some or all communications you receive from us, please select ‘unsubscribe’ from emails that you receive from LitWits.

You may see our ads on third-party websites or mobile apps because we participate in advertising networks. Ad networks allow us to deliver relevant advertising to you based upon information we receive about your interests. As required by law, you may (1) have the right to access certain personal information we maintain about you; (2) request that we update or correct your personal information; (3) object to the processing of your personal information or withdraw your prior consent, if applicable; and (4) ask us to block or delete your personal information from our database. To exercise these rights, please contact us as indicated in the “Contact Us” section of this Privacy Policy. To help protect your privacy and maintain security, we may take steps to verify your identity before granting you access to the information.

We only obtain information that is reasonably necessary to facilitate and optimize the Site and our services to you. If you choose not to provide us certain information, we may not be able to offer you certain products and services, and you may not be able to access certain features of the Services.

Children’s information

Protecting the privacy of children is especially important to us and LitWits is committed to compliance with the Children’s Online Privacy Protection Act (COPPA). We take children’s privacy seriously and encourage parents to take an active role in protecting their children’s privacy and online experience at all times. LitWits does not knowingly collect any Personal Information from children under the age of thirteen (13).

If we discover that we have collected any Personal Information from a child under the age of 13 without parental or guardianship consent, we will remove that information as soon as possible. If a parent or guardian becomes aware that their child (who is under the age of 13) has provided information without parental or guardianship consent, please contact us as specified in the “Contact Us” section of this Privacy Policy. Upon your request, we will delete such information from the Site and files within a reasonable time period. These practices are in place to ensure child privacy and safety, and in compliance with prevailing federal laws.

California Disclosures

If you are a California resident and have an established business relationship with us, California Civil Code Section 1798.83 permits you to request a notice disclosing the categories of Personal Information we have shared with third parties, if any, for the third parties’ direct marketing purposes, during the preceding calendar year. To request a notice, please submit your request through the “Contact Us” section of this Privacy Policy. California law also permits residents of California to opt-out of LitWits’ disclosure of Personal Information to third parties for their direct marketing purposes. You may choose to opt-out of the sharing of your Personal Information with third parties for marketing purposes at any time by submitting a request in writing to the contact information provided below. Please note that LitWits does not share or disclose your Personal Information with third parties for their direct marketing purposes.

International users

As the Internet is a global environment, collecting and processing Personal Information may involve the transmission of this data internationally, including into and/or outside of the United States. Therefore, by communicating electronically with us, you acknowledge and agree to your personal data being processed in this way.

Specifically, if you are located outside of the United States, please be aware that by using the Site, your information may be transferred to the United States or other third-countries, the privacy laws of which may be deemed by your country to have inadequate data protection. If you are located outside of the United States and voluntarily submit information to us, you thereby consent to the general use of such information as provided in this Privacy Policy and to the transfer of that information to, and/or storage of that information in, the United States or other third-countries.

If you reside in the European Union, you have certain rights under the European Data Protection Regulation (“GDPR”), including:

  • The right to be informed of the Personal Information we collect and how we process and use that data;
  • The right to request access to your Personal Information;
  • The right to request that inaccurate Personal Information be rectified, or completed if incomplete;
  • The right to request erasure of your Personal Information;
  • The right to restrict our processing or use of your Personal Information;
  • The right to obtain and reuse your Personal Information for your own purposes;
  • The right to object to our processing or transferring your Personal Information;
  • The right to withdraw your consent for us to use your Personal Information; and
  • The right to lodge a complaint with a supervisory authority under the GDPR.

We have a legitimate interest in collecting and processing your information for the purposes we have outlined in this Privacy Policy and so that we can optimize your experience with Site. We retain and store your information only for as long as we have a legitimate business purpose to do so and in accordance with our data retention policies and this Privacy Policy.

In response to receiving a request for one of the rights set forth above, LitWits will timely comply with the request within the time periods set forth in the GDPR for each right. Several of the above rights are not absolute and apply only in certain circumstances. LitWits will comply with requests for those rights as set forth in the GDPR. We are intent on resolving any issues relating to our handling of your Personal Information, and you may contact us at any time regarding any questions or concerns.

We do not make any decisions about you based on automated processing of your information.

Social Networks

When you use the social networking features on our Site, you may be asked to log in to a social network using your social network credentials (for example, your Facebook user ID). When you log in, we may collect information about you (including Personal Information) from that social network. In addition, when you use one of the social networks sharing tools available on our Site, the social network operating the tool may collect information about you based on such use. The social network’s use of the information will be subject to its own privacy policy, which may be different than ours.

Security and storage of information

LitWits stores your information using reasonable security precautions and for only as long as we think reasonably necessary. We make every effort to ensure that all of the transactions that occur on the Site are secure. We store your information securely, using industry-compliant encryption technology.  Credit card information is not stored on our site.

If you have any specific concerns or questions, please don’t hesitate to contact us. We are very concerned about the security of customer data. However, no transmission of data is guaranteed to be completely secure. It may be possible for third parties to unlawfully intercept transmissions.

Changes to this policy

By using the Site, you agree to the terms and conditions of this Privacy Policy. If you do not agree, please do not use the Site. We reserve the right, in our sole discretion, to change, modify, add, or remove portions of this policy at any time. Please check this page periodically for any changes. Your continued use of the Site following any changes to these terms shall signify your acceptance of those changes.
